MINUTES OF THE 20TH PPVE MEETING

Minutes of the 20th MC Meeting held on Sunday, 3rd Aug 2008 at the MC Meeting Room at 3:00 p.m.

The meeting was called to order at 3:00 p.m. by the Chairman.

1. The Chairman thanked all present for attending the meeting. The minutes of the last meeting was confirmed and proposed by Ms. Lim Chooi Pei and Mr. Danny Yew.

There were 4 topics in the Agenda viz :
a) Procedure to clamp cars violating House Rules & issue with security entry
b) Status of Auditors
c) Accounting Review
d) Other Matters:
- Festival
- Renovation Rubbish and clearance
- Suggestion for installing swing at children’s playground
- Fish Pond Mini Pump

e) Next Meeting Date

Procedure for Clamping Cars

Mr. Benny of Guardian Securities informed all present that visitors coming in should register their names and given the Visitor’s Pass. After 15 minutes, reminder will be given for another 10 minutes. If the Visitor was not out by then they will clamp the car. For those who parked at the lobby, after the first fifteen min., first notice will be given. A 2nd notice will be given after 15 minutes and after the 2nd notice, clamping will be implemented. At the same time, it was agreed that the present system be deactivated and five proximity card will be given to the guard for visitors entry. Benny will confirm the quantity of cards later. At the same time, it was agreed that the locks should have three sets of keys of which one set to be handed to the admin. Office. The compound for unlocking the clamp is RM50.00 (Ringgit Malaysia Fifty only)



Status of Auditors
It was agreed that we should negotiate with the auditor for a thorough investigation and auditing all the accounts. With the professional advice, we can file and proceed with the claim of car park rentals which doesn’t reflect in the account.

The total maintenance charges collected for the month of June were as follows:-

Other Matters
1. The “Phor Tor” Festival will be held on 14th August 2008. Notice should be put up to inform the resident and the time will be from 11am to 6p.m.

2. The Latern Festival will be celebrated on 14-09-2008. It was suggested that a subcommittee to setup to organize and it was agreed that Mrs Soong, Elaine and Brenda to be informed to help to organize the festival.

3. Deepvali will be celebrated on Saturday, 01-11-08. It will be on pot luck basis.

4. As for Christmas and New Year it will be celebrated on 31st December, 2008

5. It was noted that the contractors for 108-3A-07 have left their renovation materials at Block 108. PPVE Admin Officer was asked to inform the owner to remove their stones and rubbish soonest possible. It was agreed that refundable renovation deposit of RM2,000 should be imposed so that contractors would not leave their rubbish behind.

6. The suggestion for installation of three swings at children’s playground was agreed by all present. The quotation for the swing will have to be finalized first. Council member to get the quotation.

7. So far we have received 7 complain for water seepage and 5 complain for wrong parking lot. Time frame for water seepage will be one month.

8. It was suggested by residents that the lifts need new face look and it was suggested that we should put wall paper to beautify the lifts. Council member will be in-charged to find ways for beautification of the lifts.

9. PPVE Admin Officer informed all present that Techware have taken back all the office equipment and furniture and a Delivery Order was signed by their representative.

10.We have terminated the Astro agreement and this save the management RM120 per month.

11. The quotation from Prestige Pools for replacement for mini pump for fish pond and repair will cost RM400.00 The maintenance fees for fish pond is RM120 per month.

12. The application for proximity card from Azhar Marzookhy was not approved pending on submission of his strata title for proof of his parking lot no. He has two parking lots only but a car parking lot was created in between the two parking lots. It was agreed that the created parking lot should be chained up.

As for application of proximity card by Gooi Siew Hiang (108-10-07) was approved as she fulfilled the requirement.

The application for proximity card by tenant Chew Jong Hann was approved on condition that the post dated cheques for RM 408.77 dated 30-09-08 should be cleared. If the cheque was dishonoured, then the card will have to be stopped.

The application for lift access card from Tan Cheng Keat (106-03-01),Chua Chee Keong (104-02-07) and Ng Yuu Keng (104-07-09) were approved as they paid their maintenance fees up-to-date and so far no complains were received from other residents.

13. Council member has advised that the rental of car park should be collected on monthly basis until such that the Tenancy Agreement to be signed between PPVE and the tenants for the unshaded parking lots were ready. PPVE Admin Officer to prepare the letter for renewal of the monthly rental tenancy for council member's approval.

14. The rental for BBQ Pit and Multi-Purpose hall can be approved once there are no arrears in maintenance charges.


15. The mc has unanimously agreed that we should take action against Alice for keeing her dog at Villa Emas and bring her dog down to the garden. She has not complying the notice given to her. MC has decided that we should block her proximity card until she give an undertaking or promise to comply with the notice.


The next meeting date will be at 3.00 p.m. on 17th August, 2008 at the MC meeting room.

The 20th MC meeting was adjourned at 6.00 p.m. with a vote of thanks to the chair.

kindly do not pass the lift proximity card to drive-thru registered car owner. if they are a guest, the owner of units should come down and pick their guest up. We just don't know what they will do if they can access to any floor and they just need to pay RM50 to claim back the car.

HI I just read a notice at the pool..

May I know why? that we are not allowed to keep pets at ANY vicinity Villa-Emas?

IMO, this rule should be abolished. If dogs are disturbing other residents, then special action should be taken against the owner. Not by slapping a general rule that nobody is allowed to keep any dogs anywhere?

If somebody park their car in a wrong lot, does it mean PPVE should completely ban all cars from coming in?

Please bear in mind that when you signed up the SPA, one of the house rules clause stated no animal pets allowed in the condominium.

I do not see any such clause in my tenancy agreement..

and even it if it is on some other fine print agreement between the owner and the management
rationale management would not enforce such ridiculous rule.

how about clauses on nuisance? does screaming children Constitutes to public Nuisance? Can we enforce a rule that says all children must be sent away until they stop screaming? Doesn't make sense right?

There is such thing as being reasonable.

Hi resident,

Now I know why you are not aware of such clause because it's not stated in your tenancy agreement. As I have stated, the clause is stated in the master Villa Emas Condominium House Rules, clause No. 2.4. It applies to all occupancy of Villa Emas Condominium. According to the clause, the management reserves the right to remove any pets found within the Condominium at the owner's expense. Don't say you are not aware of it. You have been told. Ignorance is not an excuse.

If I'm not mistaken, this clause are commonly found in ALL condominium, apartment, hotel and building whereby peoples are staying within the same building. I'm not surprise if this clause is part of the standard requirement as stipulated in the Housing Act of Malaysia. It is to protect the people staying in the same building from possible attack, nuisance and littering from the animal pets.

Off the record, I also do like to rare pets if there is no such clause appear in the rule book.

Hi Resident,

I agree that somehow screaming children constitutes to public nuisance. However, how can you compare little children to animals?? As a parent, if the kids makes noise, it's our responsibility to ensure it does not happen.

Back to the pet issue, i think it's very irresponsible of tenants with pets to let pets make noise.

I dislike it when i see tenants hugging their pets in the lift or walking their pets at the swimming pool area. Be sensitive, some ppl are just not into pets and would not like to be around with them.

how can u compare your kids (human)and pets (animal). When kid scream or cry, they are human. Condominium are for human to stay. Whereas dog or cat are animal that got house rules stated clearly that pets are not allow in condominium. I am very sad that you can compare kids with animal. Hopefully you are not someone parents. Pls note that we have other race who stay in Villa Emas that they are not suppose to touch dog or being touched by dog. Worst still if they accidentally step on dog poo. Hope you can be considerate as this is part of a community living where we has to adopt to this rules.

it is indeed sad to know we have people who reason without sense .... educate you may be bit indeed it reflect the stupidity of the person when comparing baby with dog. What a shame of this tenant. With that mentality you should be staying in Rifle Range ....

There are rules for leaving in common property and it is specified clearly in the house rules and the law attached to it.
If you cannot follow them then leave Villa Emas and go to flat leaving like Rifle Range. A person with that mentality should not be staying in Villa Emas because it has the mentality of those staying in Rifle Range or any other low cost flat. Please leave ...

If you are ignorant of it then find out and do not be so bold to asked it to be abolish. If you can take this leave with your dogs and go to high leaving place like Rifle Range as this mentality reflect that clearly.

First and foremost I have to compliment the MC for doing a good job especially to run on our own. It is indeed not an easy task as you guys are working on improvement without getting anything and has a heavy responsibility of doing well .... which as a resident I have to compliment you guys. Keep up the good work. I can see alot of changes to the security (improvement), swimming pool is great and clean compared to earlier 4 months ago. During my stay here I saw people working on the garden as well as swimming pool daily. That is how it should be done ..... keep up the good job!
Having this blogspot is great too and I believed MC has the great people around with alot of capability.
However, reading the mail on pets I am disgusted with the tenent that questioned the house rules and is ignorant of it. It is indeed ashame to have tenent like this worst still if it is a unit owner. It is important that in common living, there must be rules to follow which I believe is stated in the Strata Title Act as well as Housing Act. For tenent or unit owners who do not follow, take legal action against them and as resident we will support the MC.
To see his arguement of comparing dog and baby, this tenent is showing his stupidy in the arguement. Rules are for us to follow and if you can follow then leave the place. Can you imagine if there is no house rules the condominium would be like another low cost flat like what a blogger has called it as "Rifle Range Flat". I fully support the blogger who asked the tenent to move there. It he should move there as he does not have the mentality to stay in villa emas.

To all the council members,
Keep up the good job as it is not an easy job. I came to look at this website and I do not think there is any MC run independently by themselves has been so innovative as PPVE team. Congratulations and keep up the very good work! Not the whole of Penang or Malaysia for the matter. Even a property managing agent company would not be able to be so transparent as you guys.
However, I have also read through the mail and came across some resident who are not only ignorant of the law living in condominum like ours and is nastly too with the remarks that they have made.
The blog is for us to share our views and queries for improvement and support in whatever form that we can contribute as non partitative resident for the MC to do a better job. However, I can see we have educated resident who are very selfish and is ignorant about law and living in common property.
I believed this are the few who cares only for their own interest and the MC should be hard on them.

Security

There are too many cases of theft recently, please help to start patrolling all the floor frequently.

We are all scare and feel that Villa Emas is not a safe place anymore because of recent frequent theft issue.

Please help to make Villa Emas a safer place to stay.

We are scare especially during the day time as there are less people around.

Please i beg the security leader / team and security company to look into this matter seriously.

Entrance gate at the security guard house

i noticed it has been a week anyone can freely access our apartment. I didn't blame the management as i know management is doing a good job.

but please help to fix the gate and this time please choose a better quality gate.

The shed is also almost fall down.

Kindly help to look into this matter urgently.

Propose to have a TV that captured from the CCTV, means that anyone can see themselve live on the TV screen when they are captured by CCTV.

Of course there are certain cost but end of the day it will be worth it.

We belive this will fear most of the theft as they can see them selves on the TV, live.

Also is anyone maintain or look into the CCTV on what's happening daily and most of the time OR the CCTV will just leave it there for the sake of tracing purposes, only after the issue happened? Just curious.

Appreciated If there are dedicated guard to sit in front of the CCTV and check everthing, we belive he or she should be able to trace the internal theft.

Or if the patrolling is very often then the guard also should be able to HUNT DOWN the internal theft.

They are always a way to track down the theft probably the security company can work with the experts such as our respective Penang inspector or police force.

Appreciate your team's help to look into this matter.

we saw about 6 dogs running around Villa Emas for the past few days since last week and barking around.

then we have informed the guard few times and they just answered "Anjing masuk dari luar".

Please help to look into the matter because if dogs can come in from "luar" means theft could come in too.

Kindly help to contact the authority to clear this dog issue.

It will be good to clear the dog issues because there are still residents that don't like to follow the rules.

Issue 1 - becaue of dog they could cause thief freely enter our apartment using the staircase:
example: there are one couple used to walk the dog down from the staircase and put a stone to make sure the starcase door is not closed, so that they can use the staircase to walk back home and make sure nobody sees them, but they didn't reaslise with this bad habit, could cause break-in due to the thief can now use the staircase to enter. So no point our respective commitee work hard to control the lift with camera because we have this irresponsible couple to do this. It's a chinese young couple if not mistaken.

Issue 2
Very ofter during night time there are one man feel so proud to bring his dog to the car park probabaly to shit or pee on someone's car type or side of the care.

Even the owner will pick up his/her dog's shit from the garden, can the owner pick up the urine. Please be hygiene to avoid disease in Villa Emas.

Please make Villa Emas a clean place to stay. Please support our respective committee. They are doing a good job.

The person who compared baby with dog, should go back and asked his/her parents why his/her parents did not move them away from their house apart from then or anyone else once he or she cried or screamed during he or she was a baby.

Common! Don't have this type of stupidity thinking.

Rules is rules, if the road sign stated 80km/hour, if you are not following you will be fine.

2009 Jan 1 09, rear seat belt must be fasten, so everyone should fasten the belt otherwise you will be fined, unless you are not spotted.

But without faster a rear seatbelt also a stupidity of the passenger or may driver because faster rear seat belt saves life. Everything implemented comes with safety reason.


Dogs running freely around by passing urine and shit can cause a desease. CAN THE DOG OWNER PICK UP THE URING OF THIER DOG PEE AT OUR BEAUTIFUL GARDEN.

RESPECT THE GARDENER WHO ARE CLEANING OUR GARDEN UNDER THE HOT SUN, THEY ARE THERE NOT TO PICK UP DOG'S SHIT DONE BY YOU IRRESPONSIBLE RESIDENT.

Remember:
NOBODY IS ABOVE IN THE LAW IN THIS PLANET.

Hi all,

Let me update the bloggers of Villa Emas Condominium. The MC has taken actions those you refused to abide the Additional Bye-Laws of Villa Emas Condo (pursuant to section 44 of the Strata Tiles Act 1985(Note: Villa Emas House Rules no longer applicable).As a result of it, one resident has brought the MC to court.

The MC has been sued by one unit owners, Koay Poh Kee (Alioe) & Chan Lian [unit 106-12-03)for taking action against them for bringing their dogs at Villa Emas Condo. In the suit, they have made unfounded allegations against the MC.

The MC has filed an application to strike out the claim on the basis that the whole action is frivilous, vexatious and/or an abuse of process of court.

It is important to note that the MC is doing its best and taking whatever actions that is necessary to make Villa Emas a better place to stay.

We have used comments in the blogs to support the application to strike out the claim. We find it that bloggers wants stern actions to be taken against those who failed refused and/or ignored to follows the Bye-Laws of Villa Emas.
